The Supplier hereby indemnifies and holds Sibanye-Stillwater, and its respective directors, officers, agents, employees, members, absolutely and forever harmless from and against any and all claims, actions, damages, suits, liabilities, obligations, costs, fees, charges, and any other expenses whatsoever, including reasonable attorneys’ fees and costs, that may be asserted by a third party against Sibanye-Stillwater (or it’s aforementioned affiliates) in connection with the misrepresentation, negligence, misconduct or any other action of the Vendor, in relation to the Supplier’s tender advertised on Sibanye-Stillwater’s official website.
